Terms and Conditions

By applying to use our services or commencing use of any of our services, you agree to be bound by these Terms and Conditions. Your agreement is indicated by submitting an application, providing confirmation (if requested), or beginning use of our services, whichever occurs first.

These terms apply to all services we provide, including domain name registration, website hosting, email services, spam and virus protection, email marketing, hosted applications, downloadable file backup software, Search Engine Optimisation (SEO), secure web pages, SMS services, translation services, and related goods or services (collectively, "Services").

"Server" refers to the computer server equipment we operate. "Website" means the space on the Server allocated for your internet presence. A "Secure Web Page" refers to an encrypted page for secure data collection. "Search Engine Optimisation" refers to efforts aimed at improving your site’s ranking in search engine results.

Domain Name Registration

• We don’t guarantee a requested domain will be registered. Wait for confirmation before taking further action.
• If fraud is suspected, we may require ID verification (e.g., driver’s license or passport).
• Domain use is subject to the naming authority’s terms. Registration fees are non-refundable.
• We’re not liable for disputes between you and third parties regarding domain use. Suspension or cancellation is at our discretion.
• Domain transfers out are billed at our standard rates.

Hosting, Email & Web Services

• No guarantees are made for information accuracy or data integrity. Insurance for hosted data is your responsibility.
• Your website must not:
  • Violate laws or include harmful, obscene, or infringing content;
  • Contain viruses or promote illegal activity.
• We may suspend service for abuse without notice. After three suspensions, the account may be terminated.
• Email use must comply with the Spam Act 2003. Spam or unsolicited emails may lead to instant service termination.
• You're responsible for your login credentials. We’re not liable for misuse until notified.
• We aim for secure hosting but can't guarantee complete protection from hacking.
• Our virus protection offers risk mitigation, not full prevention.
• Excess bandwidth: $0.055/MB, invoiced monthly (14-day payment terms).

Web Design

• Standard packages include a 5-page design unless stated otherwise.
• We may engage third-party developers and share content for project completion.
• Ensure you keep copies of existing websites before rebuild. We offer archiving at our standard rates.
• All content provided must be legally compliant and rights-cleared. We’re not responsible for future content use.
• Content must be received within 1 month of invoicing. Delays may lead to admin hold or cancellation.
• Feedback is required within 7 days. Late revisions incur $80/hour charges.
• Projects can be paused for up to 6 months ($200 fee). After that, projects are cancelled with no refund.
• Extra layout concepts: $350 each, payable upfront.
• Clients must own the rights to all supplied images.
• Bugs from previous code (within 30 days of publishing) are fixed free. All other changes are billed.

Static Sites

• 100% upfront payment. Cancellations before production incur a $300 fee. No refund once production begins.

CMS & E-Commerce Sites

• 50% upfront, balance before go-live. $300 cancellation fee before production. No refunds after.
• We help with merchant facility applications, but approval is not guaranteed.

Template-Based Designs

• Non-transferable. Requires active “Business Hosting”. One round of up to 10 changes is included. Extra changes: $80/hour.

SEO Services

• We aim to boost your site’s visibility, but no ranking guarantees are made.
• All link submissions require your review and approval.

SMS Services

• Free for personal use only. Misuse may lead to suspension.
• Do not use for spam, threats, or illegal purposes.
• You're responsible for all content sent through the service.
• We reserve the right to monitor and take action on misuse.

Translator Services

• Free for non-commercial use. Clear, respectful language required.
• Misuse may result in access removal.
• Use must comply with laws and respect copyright.

General Terms

• Service interruptions may occur. We’re not liable for data loss or downtime.
• You must have all rights/permissions for your content and domains.
• You indemnify us against third-party claims.
• We may terminate services if you:
  • Don’t pay on time,
  • Breach these terms,
  • Become insolvent, or
  • Violate any end-user agreement.
• After termination, we may hold data for 14 days (retrievable at $80/hour), then delete permanently. Services stop immediately.

Payments

• Annual subscriptions: 30-day terms. Monthly subscriptions: 7-day terms.
• Late payments attract 12% p.a. interest and recovery costs.
• Credit card surcharges: 1.9%. Auto-debit applies if authorised.
• Late fees beyond 30 days: $11.00.

Liability

• We exclude all warranties unless explicitly stated.
• Our liability is limited to fees paid for the service in question, with claims to be made within 12 months.
• No liability for indirect or financial losses (e.g. lost revenue or data).

Pricing Structure

Unless otherwise agreed in writing, our standard rates Current as of July 2025 are:

Residential Prices

• Business Hours (Mon–Fri, 9am–3pm):
  • $110 for the first hour
  • $80/hour thereafter (billed in 15-minute increments)
• Call-Out Fees (Outside Business Hours):
  • Mon–Fri: $240
  • Sat–Sun: $300
  • Public Holidays: $400

Business/Commercial Prices

• Business Hours (Mon–Fri, 9am–3pm):
  • $110 for the first hour
  • $110/hour thereafter (billed in 15-minute increments)
• (Outside Business Hours):
  • Mon–Fri: $240/hour
  • Sat–Sun: $300/hour
  • Public Holidays: $400/hour

All charges are in AUD. Additional service-specific fees may apply.

Governing Law

These terms are governed by Australian law. Any disputes will be handled exclusively by Australian courts.
